How can governors create new Opportunity Zones in their state if new areas become distressed?

    They cannot. The Opportunity Zones are set in stone, and only federal legislation can open up the ability to designate new ones or change existing ones.

    As of today, no more tracts may be designated. It will take legislation for that.

    Under existing law, governors do not have the power to create any new opportunity zones.
