How do the final OZ regulations provide RIC and REIT shareholders flexibility in timing QOF investments and capital gain dividends eligible for QOF deferral?

    The amount of capital gain dividends from a RIC or REIT has two options under the final regulations. The default is that the 180-day clock does not begin until the last day of the shareholders' tax year, otherwise a taxpayer may use a 180-day clock beginning on the date of receipt. Note that the application of the final regulations before their enactment date requires relying fully on the new guidance.
